Labor-Management Relations
The firm represents both union and non-union firms in labor
matters. Shawe Rosenthal has successfully represented
non-union clients in over 3,000 NLRB elections. We
often serve as the company’s representative in collective
bargaining negotiations and arbitrations. Our experience
allows us to respond immediately to emergency situations,
such as strikes and picketing. We advise clients on
the labor law implications of changes in their businesses,
such as mergers, acquisitions or relocations.
Employment Discrimination
Shawe Rosenthal defends all kinds of employment discrimination
claims, including race, sex, age, national origin, religion
and disability discrimination, sexual harassment and retaliation.
We represent our clients in administrative investigations
conducted by the EEOC and other federal, state or local
agencies. We defend our clients in lawsuits in federal
and state court, including class actions and jury trials.
Employment Litigation
We handle a variety of state law claims such as breach
of contract, wrongful discharge, fraud, negligent hiring,
assault and battery, defamation, and intentional infliction
of emotional distress. We also defend claims for benefits
under ERISA and COBRA, public accommodation claims, and
WARN Act claims. One of the few areas of law in which
we represent plaintiffs as well as defendants is covenants
not to compete and trade secrets.
Wages and Hours
We defend employers in wage-hour litigation, including
overtime, minimum wage, wage payment, and family medical
leave claims. We handle complex class and collective
action claims, as well as individual actions. We also
provide advice concerning wage-hour practices, conduct wage-hour
audits and represent clients in investigations and audits
conducted by government agencies.
OSHA
We provide on-site representation to clients during OSHA
investigations, including accident investigations.
We defend safety and health citations before the OSHA Review
Commission and state agencies.
Affirmative Action
We represent our clients in compliance reviews conducted
by the OFCCP. We often draft affirmative actions plans
for them.
Advice and training
Much of our practice is devoted to preventing problems.
We advise clients concerning policies and procedures, conduct
internal investigations, help plan major employment decisions
such as RIFs, review individual employment decisions such
as discipline and discharge, review and draft employment
contracts and severance agreements, and train management
